Excerpts:

Q (defendants lawyer): And were you subpoenaed to do this desposition?
A (MacDonald): No, sir.

Q: (defendants lawyer): So you're voluntarily just offering this information?
A (MacDonald): Yes.

Q (defendants lawyer): So is it typical in NOVA to give good reviews to someone and then not promote them or tell them that they have a problem ? Is that the way your corporation worked?
A (MacDonald): That's not the way it was supposed to work certainly; no.

Q: (defendants lawyer) Because no one would ever be able to correct a behaviour if they didn't know it was a problem. Right ?
A: (MacDonald) I agree.

Q: (defendants lawyer) Everything you're saying is based upon things that you heard from other people?
A: (MacDonald) Yes. And it was information that I gained as part of the overall management process in place at NOVA.
