US Entry Waivers Even though you have a Canadian Record Suspension, you may still require a waiver to legally enter the United States of America. According to reports from Canada, the U.S. does not recognize your Pardon or now known as Record Suspension from the Canadian Government.   You are automatically banned from entering the US if you have ever been convicted of a criminal offence. That record will appear each and every time you attempt entry to the US. Obtaining a US waiver is the only way to legally enter the US. Refused Entry The US can refuse admission to any person convicted of a criminal offence. This means that if you have a criminal record, you should obtain a US entry waiver to ensure that you will not be turned back at the border and that you can legally travel to, or through, the US.Anyone granted a US entry waiver should be at no risk of being refused entry to the US. A US entry waiver overrides any personal discretion border guards may have.   The US Customs and Immigration service has computer access to the Canadian CPIC Police Records System. They can instantly determine if you have a criminal record, a warrant or have ever been arrested in Canada. Once that information is in their system, it is there forever. Once you obtain a waiver, it is valid for one to five years and must be renewed. There is a filing fee that must accompany your application for a waiver.
